Terms and Conditions of Use

1. Introduction

These Terms and Conditions govern access to and use of the geosonar.ai website and the GeoSonar SaaS platform, accessible at app.geosonar.ai.

Use of the services implies full acceptance of these Terms.

2. Service Provider

3. Target Users

GeoSonar is a professional platform intended exclusively for companies, professionals and VAT-registered entities. The services are not directed at consumers within the meaning of Legislative Decree 206/2005 (Consumer Code).

4. Description of Service

GeoSonar is a SaaS platform designed to help companies and professionals monitor, understand and manage brand presence in generative engines and in responses produced by artificial intelligence systems.

5. Account Registration

To use the service, it is necessary to create an account. The user is responsible for all activities carried out through their account.

6. Subscription Plans

GeoSonar may offer a free version, a Pro licence and an Agency licence. The features of individual plans may be modified over time.

7. Automatic Renewal

Subscriptions are recurring and automatically renew upon expiry of the subscribed period. The user may stop automatic renewal at any time through their account or via the payment systems used. Stopping renewal does not entail the refund of amounts already paid.

8. Payments

Payments are processed through third-party providers, including Stripe and PayPal. GeoSonar does not store complete payment card data.

9. Refund Policy

Unless exceptional cases are assessed at GeoSonar's discretion, amounts paid for use of the service are non-refundable. Special requests may be sent to info@geosonar.ai. GeoSonar reserves the right to assess each request on a case-by-case basis.

10. No Right of Withdrawal

Since the service is directed exclusively at professionals and businesses, the right of withdrawal provided for consumers under the Consumer Code does not apply.

11. Nature of the Service

GeoSonar provides analysis, monitoring and decision support tools. The information, reports and insights generated by the platform are exclusively informational and strategic in nature and do not constitute professional advice, guarantee of results or performance promise.

Operational decisions made by the user based on the information provided by the platform remain under their exclusive responsibility.

12. No Guarantee of Results

GeoSonar has been designed, developed and continuously updated to maximise the effectiveness of analyses and support the improvement of brand visibility in generative engines. However, GeoSonar does not directly carry out the operational activities required to implement the actions suggested by the platform.

Results depend on external factors including: implementation of suggested actions, evolution of AI models, algorithm changes and competitive market dynamics.

13. Evolution of AI Models

Artificial intelligence systems are subject to continuous changes, updates and modifications beyond GeoSonar's control. GeoSonar cannot guarantee the stability of AI models, the permanence of their operating logic, or the availability or accuracy of information generated by third parties. Any changes to AI models may affect the data and outputs produced by the platform.

14. Limitation of Liability

To the extent permitted by law, GeoSonar shall not be held liable for economic losses, loss of profits, loss of business opportunities, loss of data, indirect damages or strategic decisions made by users based on the information provided by the platform.

In any case, GeoSonar's total liability shall not exceed the amount actually paid by the user in the twelve months preceding the disputed event.

15. Intellectual Property

All rights relating to the platform remain the exclusive property of GeoSonar S.r.l. The purchase of a licence does not entail any transfer of intellectual property.

16. Ownership of Data and Reports

Data entered by users and reports generated within created projects belong to the user. GeoSonar claims no rights over content uploaded or produced on behalf of the user.

17. Prohibited Activities

• copying the software or performing reverse engineering
• reselling the service without written authorisation
• granting sub-licences
• using the platform for unlawful activities
• compromising system security
• attempting to access other users' data

Any partnership or referral agreements must be governed separately.

18. Service Availability

GeoSonar undertakes to keep the platform available and operational, but does not guarantee the absence of interruptions, malfunctions, scheduled maintenance, force majeure events or problems arising from third-party services.

19. Account Suspension and Closure

GeoSonar reserves the right to suspend or close an account in the event of breach of these Terms, fraudulent use, activities that may compromise service security or non-payment.

20. Changes to Terms

GeoSonar may modify these Terms at any time. Changes will take effect from the date of publication on the website. Continued use of the service will constitute acceptance of the changes.

21. Governing Law and Jurisdiction

These Terms are governed by Italian law. For any dispute relating to the interpretation, validity or performance of these Terms, the Court of Rome shall have exclusive jurisdiction.
